Conditions of consignment
The following conditions of consignment apply. This is a courtesy translation; the German version is binding.
The consignor receives the full hammer price less an auction fee of 30% plus statutory VAT.
A lot fee including photographs of € 17.85 including statutory VAT is agreed. Different lot fees may be agreed for individual or all objects and are then stated with the object. Insurance of the consigned items is 1% (plus VAT) of the sum of the start prices.
If the consignor withdraws items before the auction, a fee of 25% plus statutory VAT of the agreed start price is payable. For objects without a start price, or with a start price of up to € 100, € 25 plus statutory VAT are payable. Once the catalogue has been completed, withdrawal is generally no longer possible. If, in justified exceptions, items that already have absentee bids are withdrawn, 25% plus statutory VAT of the start price is charged. Further costs, such as expert invoices, are also to be reimbursed.
The auction order expires after 6 months or after the auction has taken place. It renews for a further 3 months unless it is terminated.
Collection of unsold items is the sole responsibility of the consignor.
If the items cannot be auctioned in the next possible auction, or if a private sale is agreed for parts or the whole consignment, a private treaty sale may take place. At further saleroom auctions the start price is automatically reduced by 50% each time. All other points of these conditions then apply as for a consignment to a live auction.
If the consignor insists on start prices, these lower start prices are fixed by mutual agreement. Below that price a sale may only be made subject to reservation. Handing over the items at this conditional bid requires the consignor’s written consent within 10 working days.
As a rule, if the consignor does not set a start price, the auctioneer sets one at his discretion. If items are offered without a limit, the start price is at least € 10.
The consignor is liable for information concerning the authenticity, provenance or age of the items consigned. The consignor also warrants that items from abroad were imported properly.
The auctioneer insures the consigned items, at the consignor’s expense, against burglary, theft, fire, water and vandalism. The insurance fee is already included in the lot fee. The auctioneer is not liable, on any legal ground, unless intent or gross negligence applies.
Gold and silver objects may be auctioned below market value.
The consignor agrees that, in the case of resale-right sales under copyright law, his name and address will be passed to VG Bild-Kunst on request. If the consignor wishes confidentiality, he undertakes to pay the auctioneer a share of 2% of the proceeds plus statutory VAT on that share, which the auctioneer then remits.
Settlement is made within six weeks of the auction, subject to payment by the buyer.
The consignor receives written confirmation of the items consigned to an auction.
Any transport costs are borne by the consignor. Lorry or van with driver € 79 per hour plus statutory VAT, and helper € 39 per hour plus statutory VAT. Packing materials as incurred.
These conditions apply accordingly to private treaty sales.
Should individual points be wholly or partly invalid, the remaining conditions are unaffected.
